By using SDR Tracker ("the Service"), you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use the Service.
SDR Tracker is a sales activity tracking tool intended for individual use by sales development representatives. You may not share your account credentials, resell access, or use the Service for any unlawful purpose. You are responsible for all activity that occurs under your account.
New accounts receive a 5-day free trial with full access to all features. No payment information is required during the trial period. At the end of your trial, a subscription of $4.99/month is required to continue using the Service. No refund is applicable to the free trial period as no charge is made.
Subscriptions are billed monthly at $4.99 via Stripe. You may cancel at any time from your account settings. Cancellations take effect at the end of the current billing period. No refunds are issued for partial months already paid. All fees are exclusive of taxes, which may be added where required by law.
All subscription fees are non-refundable except where required by applicable law. Because the 5-day free trial provides full access at no charge, no refund is owed for the trial period. If you believe a charge was made in error, contact support@mysdrtracker.com within 30 days of the charge.
You own the data you input into the Service. By using the Service, you grant SDR Tracker a limited license to store, process, and display your data solely to provide the Service to you. We do not sell your data. See our Privacy Policy for full details.
SDR Tracker, including its design, code, branding, and features, is owned by SDR Tracker and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal business purposes. You may not copy, modify, reverse-engineer, or create derivative works of the Service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FIT FOR ANY PARTICULAR PURPOSE. WE MAKE NO GUARANTEES REGARDING UPTIME, DATA ACCURACY, OR RESULTS OBTAINED FROM USE OF THE SERVICE. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SDR TRACKER'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL FEES YOU PAID TO SDR TRACKER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL SDR TRACKER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to defend, indemnify, and hold harmless SDR Tracker and its operators from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.
You may cancel your account at any time through your account settings or by contacting support@mysdrtracker.com. SDR Tracker may suspend or terminate your account immediately, without prior notice, if you violate these Terms, engage in fraudulent activity, or if required by law. Upon termination, your right to use the Service ceases. We will retain your data for up to 30 days after termination before deletion, unless a shorter period is required by law.
The Service is intended for users who are at least 18 years of age. Users between the ages of 13 and 17 may only use the Service with verifiable parental or guardian consent. The Service is not intended for children under 13. By using the Service, you represent that you meet these age requirements.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA), rather than in court, except that either party may bring claims in small claims court if they qualify. YOU AND SDR TRACKER EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION. This arbitration provision is governed by the Federal Arbitration Act. Before initiating arbitration, you agree to first contact us at support@mysdrtracker.com to attempt to resolve the dispute informally for at least 30 days.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Subject to the arbitration clause above, any legal action shall be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.
We may update these Terms at any time. We will notify you of material changes by email or by posting a notice in the Service. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and cancel your subscription.
